Rubbish Removal Ruislip Service Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Ruislip provides rubbish removal, waste collection and related clearance services. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means the person, business, or organisation requesting and paying for the service.

Company means Rubbish Removal Ruislip, the provider of rubbish removal and waste collection services.

Services means any rubbish removal, waste collection, clearance, loading, transportation, or disposal service carried out by the Company.

Waste means any items, materials and rubbish that the Customer asks the Company to remove, subject to applicable waste regulations.

Site means the address or location where the Services are to be carried out.

2. Scope of Services

2.1 The Company provides rubbish removal and waste collection services for domestic, commercial and other customers. This may include collection of household rubbish, bulky items, garden waste, office waste and general non-hazardous waste, subject to these Terms and Conditions.

2.2 The exact scope of the Services will be agreed at the time of booking. Any description or estimate given on the Company’s website, in advertising or over the phone is indicative and not binding until confirmed in a specific booking confirmation.

2.3 The Company reserves the right to refuse to remove certain items, including but not limited to hazardous waste, chemicals, asbestos, clinical waste, gas bottles, oil, paint, solvents, and other items that cannot lawfully or safely be collected or disposed of by the Company.

3. Booking Process

3.1 Bookings may be made by telephone, email, online enquiry, or any other method offered by the Company from time to time.

3.2 When making a booking, the Customer must provide accurate details of the type and quantity of waste, access conditions at the Site, and any other information reasonably requested by the Company to provide an estimate and schedule the work.

3.3 Any quote provided before the Company arrives on Site is based on the information supplied by the Customer. If the information is inaccurate or incomplete, or if the waste or Site conditions differ from those described, the Company may adjust the price or refuse to carry out all or part of the Services.

3.4 A booking will be considered confirmed once the Company has accepted the Customer’s request for Services and, where applicable, the Customer has paid any required deposit or pre-payment.

3.5 The Company will use reasonable efforts to attend the Site during the agreed time window, but any times given for arrival or completion are estimates only and not guaranteed.

4. Access and Customer Obligations

4.1 The Customer must ensure that the Company has safe, suitable and reasonable access to the Site at the agreed time. This includes arranging any necessary permissions for parking, entry to private land, or access through shared areas.

4.2 The Customer is responsible for ensuring that the waste to be collected is clearly identified, accessible and not mixed with items the Customer does not wish to be removed.

4.3 The Customer warrants that it has the authority to allow the Company to collect and remove the waste from the Site.

4.4 The Customer must not request the removal of any items that are prohibited under waste regulations or that the Company has previously indicated it cannot accept.

4.5 If access to the Site is not available, or if the Company is unable to safely carry out the Services due to circumstances within the Customer’s control, the Company may cancel the visit or apply waiting time or failed attendance charges.

5. Pricing and Payment

5.1 Prices for Services are generally based on factors such as the volume and weight of waste, the type of materials, labour involved, access conditions and disposal costs. The Company will explain the pricing method applicable to each booking.

5.2 Unless otherwise stated, prices are quoted in pounds sterling and are exclusive of any applicable taxes which will be added where required by law.

5.3 The Company may provide an estimated price before attending the Site. The final price will be confirmed once the waste has been inspected on arrival. If the final price is higher than the estimate, the Customer will have the right to refuse the Service before any work begins, in which case a call-out or attendance fee may apply where previously notified.

5.4 Payment is due as specified at the time of booking, which may be in advance, on completion of the Service, or on invoice within an agreed credit period for approved account customers.

5.5 The Company accepts such payment methods as it may specify from time to time, which may include cash, debit card, credit card, bank transfer or other electronic payment methods.

5.6 If payment is not received on the due date, the Company reserves the right to charge interest on any overdue amount at the statutory rate permitted under UK law, and to recover reasonable costs of debt collection.

6. Cancellations and Amendments

6.1 The Customer may cancel or amend a booking by contacting the Company during normal business hours. Any cancellation or amendment is not effective until acknowledged by the Company.

6.2 If the Customer cancels a booking with more than 24 hours notice before the scheduled arrival time, no cancellation fee will usually be charged, unless a specific non-refundable deposit has been agreed for that booking.

6.3 If the Customer cancels a booking with less than 24 hours notice, or fails to provide access to the Site at the agreed time, the Company may charge a cancellation or failed attendance fee to cover costs incurred, including staff allocation and travel.

6.4 The Company reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, or legal restrictions. In such cases, the Company will endeavour to offer the next available appointment. The Company will not be liable for any losses caused by such cancellation or delay, subject to clause 11.

7. Customer’s Right to Cooling-Off Period

7.1 If the Customer is a consumer and the booking is made at a distance, the Customer may have a statutory right to cancel within 14 days of the booking being made. However, this right may be lost if the Customer requests that the Services commence during the cancellation period and the work is fully performed.

7.2 Where applicable, the Company will explain the Customer’s cancellation rights in accordance with UK consumer protection law at the time of booking.

8. Performance of the Services

8.1 The Company will perform the Services with reasonable care and skill, in accordance with applicable waste regulations and industry practice.

8.2 The Company’s staff will load the waste from the Site into the Company’s vehicle, unless expressly agreed that the Customer will bring the waste to a designated collection point.

8.3 The Company may, at its discretion, decline to remove any item that it reasonably considers to be unsafe to handle, too heavy or bulky for the available equipment, or likely to cause damage to property when moved.

8.4 The Company is not obliged to sweep or clean the Site after removal of waste, but may carry out light tidying where reasonably possible. This is not a professional cleaning service and should not be relied upon as such.

9. Waste Handling and Regulations

9.1 The Company is committed to handling and disposing of waste in compliance with applicable UK waste management regulations and duty of care requirements.

9.2 The Customer is responsible for ensuring that any waste presented for collection is accurately described and does not contain hidden hazardous or prohibited materials.

9.3 If the Company discovers that hazardous or prohibited materials have been included in the waste without prior declaration, the Company may refuse to remove such items, return them to the Customer, or arrange alternative handling at additional cost to the Customer.

9.4 Once the waste has been loaded onto the Company’s vehicle and payment has been received, ownership of the waste transfers to the Company, subject to the waste complying with these Terms and Conditions.

9.5 The Company will seek to divert waste from landfill where reasonably possible by using licensed recycling and recovery facilities, but does not guarantee that any particular item will be recycled.

10. Damage to Property

10.1 The Company will take reasonable care when carrying out the Services to avoid causing damage to property. However, the Customer should protect any areas or items that may be vulnerable during the removal process.

10.2 The Customer acknowledges that moving large, heavy or awkward items may present a risk of damage to flooring, walls, fixtures, pathways or driveways, particularly where access is restricted.

10.3 If the Customer asks the Company to remove items from areas with restricted access or over delicate surfaces, the Customer accepts that there is a higher risk of damage and agrees that the Company will not be liable for minor or cosmetic damage arising from the proper performance of the Services.

10.4 Any alleged damage must be reported to the Company in writing as soon as reasonably practicable and no later than 48 hours after completion of the Services, providing reasonable evidence. The Company will investigate and, where appropriate, seek to resolve the matter in a fair manner.

11. Liability and Limitations

11.1 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot be limited or excluded under applicable law.

11.2 Subject to clause 11.1, the Company will not be liable for any indirect, consequential or special loss, or for any loss of profit, income, business, contracts, goodwill or anticipated savings, whether arising in contract, tort or otherwise.

11.3 Subject to clause 11.1, the Company’s total liability to the Customer in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, will be limited to the total price paid or payable by the Customer for the specific booking giving rise to the claim.

11.4 The Customer is responsible for removing or safely storing money, jewellery, important documents and other valuables before the Services commence. The Company accepts no liability for loss of or damage to such items unless caused by the Company’s proven negligence.

12. Complaints

12.1 If the Customer is unhappy with any aspect of the Services, the Customer should contact the Company as soon as possible, providing details of the issue and the date of the booking.

12.2 The Company will acknowledge and investigate complaints in a timely manner and will seek to resolve them fairly, which may include offering a remedy where appropriate.

13. Personal Data

13.1 The Company may collect and process personal data about the Customer for the purposes of managing bookings, providing Services, processing payments, and fulfilling legal obligations.

13.2 The Company will handle personal data in accordance with applicable data protection laws in the United Kingdom.

14. Force Majeure

14.1 The Company will not be in breach of these Terms and Conditions or liable for any delay in performing, or failure to perform, any of its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. This may include extreme weather, strikes, lockouts, industrial disputes, accidents, road closures, transport interruptions, acts of God, or changes in law.

15. Variation of Terms

15.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that booking.

15.2 Updated Terms and Conditions will be made available on request and may be published on the Company’s website or other customer materials.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the Services shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services.

17. General Provisions

17.1 If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable by a court or competent authority, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by the Company in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 The Customer may not assign or transfer its rights or obligations under these Terms and Conditions without the Company’s prior written consent. The Company may assign or transfer its rights and obligations to another suitable provider, provided that such transfer does not reduce the protections afforded to the Customer under these Terms and Conditions.

17.4 These Terms and Conditions, together with the details of the specific booking and any written confirmation provided by the Company, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, representations or agreements.
